Controlled Closed Beta — Participation Terms

These Terms, together with the Privacy Notice and the BAA Provider Disclosure, are the complete agreement for the controlled closed beta. They replace, for the beta only, any production Terms of Service or Privacy Policy that may appear elsewhere. When the production service launches, the production documents apply at these same addresses and these Beta Terms end.
1. Agreement and Operator
These Terms govern your participation in the PensionPulse controlled closed beta (the “Beta”), operated by Evgeny Yakushev (the project “Life & Health Metrics,” pending incorporation as Life & Health Metrics, Inc.) (“we,” “our,” “us”). For the duration of the beta, the operator is the data controller and the contracting party; on incorporation, the program and associated responsibilities are assigned to Life & Health Metrics, Inc., and the production documents take over.
By requesting access, being approved, accessing a beta build, or providing feedback, you agree to these Terms, the Privacy Notice, and the BAA Provider Disclosure.
2. The Beta Is a Controlled Closed Test
Participation is by invitation only: you submit a request, we approve it manually, and we add you to Apple TestFlight (iOS) or Google Play closed testing (Android). Access is personal, non-transferable, and revocable at any time. You may not share access, invite others, or redistribute the application.
3. The Beta Is Temporary — All Data Is Disposable
Everything in the Beta is temporary. All accounts, activity data, BAA (aging) and aging-speed indicators, demographic inputs, financial inputs, projections, and any other data created or processed during the Beta are temporary test data. When the Beta ends, all of it is permanently deleted. None of it carries over to the production service — when production launches, you create a new account from scratch. Specifically:
- Your beta account will not exist in the production service.
- Your beta activity, aging indicators, and financial data are deleted and not migrated.
- Beta data is NOT used to train, fine-tune, or develop any model, including any future in-house model — it is excluded from any model-development dataset entirely.
- History, reports, or trends generated during the Beta are not available after the Beta ends.
Treat the Beta as an evaluation environment; do not rely on it for any real financial or health decision.
4. No Payment
The Beta is free. We do not collect payment, do not offer subscriptions, and do not process billing during the Beta. Any pricing, subscription, or sponsorship features that may appear are non-operative placeholders for testing only.
5. Health-Related Data in the Beta
With your explicit consent given during onboarding, the Beta collects activity data (steps, motion) from your device or connected services via the Platform Aggregator (Apple Health on iOS, Health Connect on Android), and transmits your activity data, sex, and year of birth to our biological-age technology provider(s) to compute your aging indicators. The provider(s) in use are listed in the BAA Provider Disclosure; the one used for a given result is also shown in your Report. Full detail is in the Privacy Notice.
This is real processing of activity-derived health-related data, even though the Beta is a test. You may withdraw consent at any time, which stops further processing and, on request, deletes your beta data.
Recommendation: because the Beta is a pre-release test, we recommend you do not enter real, sensitive financial figures. Approximate values are sufficient for testing and reduce your exposure if a defect results in data exposure.
6. Connecting an Advisor (Optional)
The Beta includes a working advisor demo. If an advisor gave you a promo code, you can connect — at onboarding or later from Profile → Subscription & Advisor — by verifying the code and giving a separate, explicit consent. Connecting grants that advisor read access to your data on the platform; it does not hand them a separate copy, and you can pause or withdraw it at any time. Your connected advisor (and their company) is always shown in your Profile, and any messages or notifications from the advisor are signed with their name and company. A promo code is normally given to you by an advisor you already have a relationship with; applying a code from an unknown third party is not how the feature is meant to be used.
7. Eligibility — 18 and Over
You must be at least eighteen (18) years old. Age is enforced from your date of birth at sign-up: if your date of birth gives an age under 18, sign-up is rejected and no data is collected. The Beta is not directed to anyone under 18, and we do not knowingly enroll anyone under 18.
8. Acceptable Use
You will not: (a) reverse-engineer, decompile, or disassemble the Beta, or attempt to extract its methodology, models, or algorithms; (b) use the Beta to build a competing product; (c) circumvent access controls or rate limits; (d) share access or invite others; (e) use bots, scrapers, or other automated tools; (f) use the Beta unlawfully; or (g) publicly disclose the Beta without our written permission.
9. Not Advice
BAA (aging) and aging-speed indicators are informational and not medical advice; the Beta is not a medical device and is not validated for clinical decision-making. Financial projections are illustrative and not financial, investment, or tax advice. Do not make real health or financial decisions based on the Beta.
10. The Beta Is Provided “As Is”; No Service Commitments
THE BETA IS PRE-RELEASE SOFTWARE PROVIDED “AS IS” AND “AS AVAILABLE.” It may contain bugs, errors, inaccurate outputs, interruptions, and incomplete features. We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. Because the Beta is a pre-release test, we make no commitments on availability, uptime, latency, performance, data-retention duration, or feature set, and the Beta may be changed, suspended, or discontinued at any time.
11. Confidentiality
The Beta — including unreleased features, the user interface, the biological-age methodology, computation outputs, performance characteristics, and known issues — is confidential. You agree not to publicly disclose, screenshot, screen-record, post about, or describe the Beta in any public or semi-public forum without our prior written permission. This obligation continues for two (2) years after the Beta ends and indefinitely for any trade-secret information.
12. Feedback
If you give us feedback, suggestions, or bug reports, you assign to the operator of the Beta (and, on incorporation, to Life & Health Metrics, Inc.) all right, title, and interest in that feedback, and grant a perpetual, worldwide, royalty-free, sublicensable, irrevocable license to use it for any purpose.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, the operator of the Beta will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data or any health or financial outcome. Total cumulative liability arising out of or related to the Beta will not exceed one hundred U.S. dollars ($100). Nothing limits liability for fraud, gross negligence, or matters that cannot be limited by law.
14. Termination
Either party may end participation at any time. We may remove you from the Beta at any time, with or without cause. On termination, your access ends and your beta data is deleted as described in the Privacy Notice and the Data Deletion page. Sections 3, 8, 9, 11, 12, 13, and 15 survive.
15. Changes; Transition to Production; Governing Law
We may update these Terms during the Beta; continued participation after an update is acceptance. When the production service launches, the Beta ends, all beta data is deleted as described in Section 3, and the production Terms of Service and Privacy Policy govern any use of the production service.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes are resolved in the state and federal courts located in Delaware. (Delaware is the intended state of incorporation for Life & Health Metrics, Inc.; it governs these Terms even though, during the beta, the operator and data controller is the founder personally pending incorporation — see Section 1.)
