Operator status during beta: This program is operated by Evgeny Yakushev personally, as the project “Life & Health Metrics,” pending incorporation. Until incorporation completes, the founder is the data controller and the contracting party.
1. What this document is
This Beta Program Supplement (“Supplement”) governs your participation in the controlled closed beta test of the PensionPulse mobile application (the “Beta”). The Beta is operated by the PensionPulse beta program, operated by Evgeny Yakushev (the project “Life & Health Metrics,” pending incorporation as Life & Health Metrics, Inc.) (“we,” “our,” “us”).
This Supplement, together with the Beta Privacy Notice and Beta Terms (each available at the links in Section 12), is the complete agreement for the Beta. It replaces, for the Beta only, any production Terms of Service or Privacy Policy that may appear elsewhere. When the production service launches, the production documents will apply and this Supplement will no longer be in effect.
2. The beta is a controlled closed test
Participation in the Beta is by invitation only. You join by submitting a request through our website and being manually approved and added to the test by us. The Beta is not a public release. It is a pre-release test made available to a limited, controlled group for the purpose of evaluating the application and identifying issues before a production launch.
Access is provided through Apple TestFlight (iOS) or Google Play closed testing (Android). You may not share your access, invite others, or redistribute the application.
3. Disposability of all beta data — read this carefully
Everything in the Beta is temporary. All accounts, activity data, biological-age and aging-speed outputs, financial inputs, projections, and any other data created or processed during the Beta are temporary test data. When the Beta ends, all of this data will be permanently deleted. None of it will carry over to the production service. When the production service launches, you will need to create a new account and start from scratch.
Specifically:
- Your Beta account will not exist in the production service.
- Your Beta activity, biological-age, and financial data will be deleted and will not be migrated.
- Beta data will NOT be used to train, fine-tune, or develop any production model, including any future in-house biological-age model. Beta data is excluded from any “Training Mirror” or model-development dataset.
- Any history, reports, or trends you generate during the Beta will not be available after the Beta ends.
Because of this, we recommend you treat the Beta as an evaluation environment and not rely on it for any real financial or health decision.
4. No payment during the beta
The Beta is provided free of charge. We do not collect any payment, do not offer subscriptions, and do not process any billing during the Beta. Any pricing, subscription, or sponsorship features that may appear are non-operative placeholders for testing only.
5. Health-related data in the beta
With your explicit consent given during onboarding, the Beta collects activity data (such as step counts and motion data) from your device or connected services (Apple Health or Google Fit) and transmits it to our processing infrastructure and to our biological-age technology provider (GeroSense) to compute biological-age and aging-speed indicators.
This is real processing of activity-derived health-related data, even though the Beta is a test. Your data is handled in accordance with the Beta Privacy Notice. You may withdraw consent at any time, which will stop further processing and, on request, delete your Beta data.
Recommendation: Because the Beta is a pre-release test, we recommend you do not enter real, sensitive financial information (actual account balances, real retirement figures). Representative or approximate values are sufficient for testing and reduce your exposure if a defect results in data exposure.
6. The beta is provided “as is”
THE BETA IS PRE-RELEASE SOFTWARE PROVIDED “AS IS” AND “AS AVAILABLE.” IT MAY CONTAIN BUGS, ERRORS, INACCURATE OUTPUTS, INTERRUPTIONS, AND INCOMPLETE FEATURES. WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW. BIOLOGICAL-AGE AND AGING-SPEED INDICATORS IN THE BETA MAY BE INACCURATE AND ARE NOT MEDICAL ADVICE. FINANCIAL PROJECTIONS IN THE BETA ARE ILLUSTRATIVE ONLY AND ARE NOT FINANCIAL, INVESTMENT, OR TAX ADVICE.
7. No specific service commitments
Because the Beta is a pre-release test, we make no commitments regarding availability, uptime, latency, performance, data retention duration, or feature set. These will be defined in the production service documents, not here. The Beta may be changed, suspended, or discontinued at any time without notice.
8. Eligibility
You must be at least eighteen (18) years old and able to enter into this agreement. The Beta is not directed to anyone under 18, and we do not knowingly enroll anyone under 18.
9. Confidentiality
The Beta, including unreleased features, the user interface, the biological-age methodology, computation outputs, performance characteristics, and known issues, is confidential. You agree not to publicly disclose, screenshot, screen-record, post about, or describe the Beta in any public or semi-public forum without our prior written permission. This obligation continues for two (2) years after the Beta ends and indefinitely for any trade-secret information.
10. Feedback
If you give us feedback, suggestions, or bug reports, you assign all rights in that feedback to the operator of the Beta (and, on incorporation, to Life & Health Metrics, Inc.), and you grant a perpetual, worldwide, royalty-free, sublicensable license to use it for any purpose.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF THE BETA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA OR ANY HEALTH OR FINANCIAL OUTCOME. TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE BETA WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). NOTHING LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR MATTERS THAT CANNOT BE LIMITED BY LAW.

13. Changes; transition to production
We may update this Supplement during the Beta. When the production service launches, the Beta will end, all Beta data will be deleted as described in Section 3, and the production Terms of Service and Privacy Policy will govern any use of the production service. Continued participation in the Beta after an update constitutes acceptance of the updated Supplement.
14. Governing law
This Supplement is governed by the laws of the State of [INSERT STATE] without regard to conflict-of-laws principles. Disputes will be resolved in the state and federal courts of [INSERT COUNTY, STATE].
